The National Industrial Court( NIC) sitting in Yenagoa has adjourned till October 6, 2015, the definite hearing on all pending applications between the Rivers State government and the 23 dissolved local government councils.
The dissolved local government council chairmen had earlier gotten an order from the NIC restraining the Rivers State government from sacking them but a Federal High Court in Port Harcourt had sacked them
The adjournment has however sparked controversy as the claimants noted that the implication of the adjournment means the attempt by the defendants to vacate the restraining order on the Rivers State government not to sack the local government council chairmen failed.
At the resumed hearing yesterday one of the defense counsel told Justice James Agbadu- Fishim that defendants have two applications which have been served on the claimants.
According to him one of the application is for an order discharging the order of interim of injunction made exparte on 22 June 2015 while the other application seek to dismiss the suit for being abuse of Court process due to the fact that the NIC has no jurisdiction.
Counsel to the claimants, R.E Wanogho told the court while some of the motions served on his clients are ripe for hearing, some are not.
